Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Munchmark iOS application ("the App"), developed and operated by James Baker ("Developer"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.

2. License

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for personal, non-commercial purposes in accordance with these Terms and the Apple App Store Terms of Service. You may not:

• Copy, modify, or distribute the App or its source code
• Reverse engineer or attempt to extract the source code of the App
• Use the App for any commercial purpose without prior written permission from the Developer
• Sublicense, sell, or transfer your rights to the App

3. User Content

The App allows you to save URLs and restaurant information to your personal iCloud account. You are solely responsible for the content you save. You agree not to use the App to save or share content that is illegal, infringing, harmful, or violates the rights of any third party. The Developer has no access to your saved content and does not review it.

4. Third-Party Services

The App integrates with third-party services including Groq (AI processing), Yelp (restaurant data), Apple iCloud / CloudKit (data storage and sync), and Google AdMob (advertising). Your use of these services through the App is subject to their respective terms and policies. The Developer is not responsible for the availability, accuracy, or content of third-party services.

5. Advertising

The App displays banner advertisements provided by Google AdMob. The Developer is not responsible for the content of third-party advertisements displayed in the App.

6. Data Accuracy Disclaimer

Restaurant ratings, addresses, phone numbers, and other details fetched from Yelp and other sources are provided for informational purposes only. The Developer makes no guarantees regarding the accuracy, completeness, or timeliness of this information. Always verify restaurant details before visiting.

7. No Warranty

The App is provided "as is" and "as available" without warranty of any kind, express or implied. The Developer does not warrant that:

• The App will be uninterrupted or error-free
• Restaurant data retrieved will be accurate or up to date
• The App will be compatible with all iOS versions or devices
• Third-party services integrated with the App will remain available

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to any loss of data or reliance on information displayed by the App.

9. Changes to the App and Terms

The Developer reserves the right to modify, suspend, or discontinue the App at any time without notice. The Developer may also update these Terms at any time. Continued use of the App after updated Terms are posted constitutes your acceptance of those changes.

10. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

11. Apple Platform

Your use of the App through the Apple App Store is also subject to Apple's Terms of Service. The Developer is an independent developer and is not affiliated with Apple Inc. Apple is not responsible for the App or its content.
